1. General

These Terms and Conditions govern all online and in-store sales made through Christopher’s Cake Shop’s website, mobile app, or retail locations. By placing an order, you agree to these Terms and Conditions. We may update these Terms at any time, and the latest version will apply from the date it is published on our website. We reserve the right to decline any order that appears fraudulent, incomplete, or in breach of these Terms.

2. Orders and Product Descriptions

All cakes are handmade and decorated by our team. Each product is unique, so minor variations in colour, decoration, or design may occur. Photos and descriptions are for illustrative purposes only. We reserve the right to make reasonable substitutions or adjustments of equal or greater value if required (for example, due to ingredient availability or design practicality).

3. Payment

• 3.1. All prices are in Australian Dollars (AUD) and include GST unless otherwise stated.
• 3.2. Full payment is required at the time of ordering unless otherwise agreed in writing.
• 3.3. Orders will not be prepared until payment has been received and cleared.

4. Collection Orders

• 4.1. All online orders are for collection from the location selected during checkout.
• 4.2. You are responsible for collecting your order at the agreed time and ensuring that it is transported and stored appropriately afterwards.
• 4.3. We are not responsible for products that are not collected on time or are damaged after collection.
• 4.4. Cakes not collected within 24 hours of the scheduled time may be disposed of, with no refund provided.

5. Delivery

Where delivery is offered, we will take reasonable steps to deliver your order on time. However, delivery timeframes are estimates and not guarantees. Risk passes to you once your order is delivered to the address provided. We are not responsible for delays or issues caused by incorrect address details or circumstances beyond our control.

6. Personalisation and Messages

Personalised inscriptions will appear exactly as entered on your order form. Please check spelling and punctuation carefully. If space is limited, we may adjust the layout or size of the message.

7. Cancellations

Because our cakes are made to order, cancellation requests must be made as early as possible. If production has not commenced, a partial refund may be approved at our discretion. Once preparation has begun, no refund will be available. No refunds are provided for cancellations made within seven (7) days of collection. A minimum 50% cancellation fee may apply.

8. Refunds and Consumer Guarantees

Due to the perishable and customised nature of our products, refunds or exchanges are only available where required by law. If your product is faulty, damaged, or not as described, you are entitled to a repair, replacement, or refund under the Australian Consumer Law (ACL). Nothing in these Terms excludes, restricts, or modifies any rights or remedies you may have under the ACL or any other law that cannot be excluded. All approved refunds will be processed to the original payment method within a reasonable time.

9. Substitutions and Variations

We may substitute ingredients or decorative elements with items of equal or greater value if required by stock availability or seasonal conditions. All decorations are subject to artistic interpretation and may differ slightly from photographs or digital previews.

10. Allergies and Ingredients

• 10.1. Our cakes are prepared in an environment that handles nuts, dairy, eggs, and gluten.
• 10.2. We do not guarantee any product is free from allergens.
• 10.3. Customers with food allergies or sensitivities should consider this before ordering and must inform guests of potential allergens.

11. Liability

Christopher’s Cake Shop is not liable for any loss, damage, or injury arising from the transport, handling, or consumption of products once they have left our premises. Responsibility for safe handling and storage transfers to the customer upon collection or delivery.

12. Gift Cards and Promotions

Gift cards are non-refundable and cannot be redeemed for cash. We reserve the right to cancel or refuse promotional codes or vouchers suspected of misuse or fraud.

13. Intellectual Property

All content, designs, images, and logos on our website or social media are the property of Christopher’s Cake Shop. You may not copy, reproduce, or distribute this material without written permission.

14. Privacy

We collect and use your personal information in accordance with our Privacy Policy, available on our website. By placing an order, you consent to our collection and handling of your information as described in that policy.

15. Governing Law

These Terms and Conditions are governed by the laws of New South Wales, Australia.
